Dear Brother Hoffa:

Thank you for your consideration regarding the changes to the Teamsters Canada Rail Conference bylaws as stated in your letter to Rex Beatty dated August 31, 2012.

I have a few questions regarding these changes as they relate to the Teamsters International Constitution.

Mr. Beatty has appointed a bylaw committee. The bylaw committee is designed to change the TCRC bylaws outside of our convention but within the parameters of the new changes to our bylaws.

My first question is, does ART. XXII, SEC. 3 (d) apply to this modification in the power of the TCRC president?

ART. XXII, SEC. 3 (d) states in part that;

Any modification of the basic duties and powers of an office, and any reduction in the salary of an officer, except as provided above, may be effective only as of the beginning of the next term of office.

My second question applies to the electronic voting. The TCRC bylaw changes have allowed for electronic voting with no safeguards in place. The President may decide the voting rules with or without the input of our convention or even the advise from the national executive committee. Eliminating the petition rules for the President and allowing him the right to control voting procedures gives him remarkable power over the bylaws. Does our International office have a protocol that the TCRC is obligated to follow for electronic voting that could insure fairness?

I am sorry to trouble you with this situation again but these matters will shape the future of the Teamsters Canada Rail Conference. Your Canadian brothers and sisters thank you for your time in this matter.
